Ownership of Content
All rights to the content available on the NYMF platform, including but not limited to graphic content (photographs, videos, illustrations), written materials, lessons and education content, audio files, program code, designs, and other multimedia elements (collectively, “Content”), are exclusively owned by D. I. Dubnytskyi (assumed name: David Dubnitskiy), operating as an individual entrepreneur. This ownership extends to all original works, modifications, additions, and derivative works created for and used within the NYMF Mobile App, https://dubnitskiy.com, and https://nymf.com (collectively, the “Services”).
Under the Berne Convention and the Law of Ukraine “On Copyright and Related Rights,” the copyright of D. I. Dubnytskyi to all original works and modifications exists automatically from the moment of creation. Registration or formalities are not required for these rights to be valid or enforceable against Users or third parties.
Trademark Notice
“NYMF” and any related logos, brand names, or marks (collectively, the “NYMF Marks”) are protected trademarks owned by D. I. Dubnytskyi. Unauthorized use of these marks – or any name or symbol that may be confused with them – is strictly prohibited unless expressly approved in writing by D. I. Dubnytskyi. Users may only display the NYMF Marks in connection with their personal, noncommercial, and nonpublic use of the Services as defined below.
Copyright Protection under the Law
All Content provided through the Services is protected under Ukrainian copyright law, international copyright treaties, and applicable intellectual property laws in other jurisdictions where the Services are accessible. Unauthorized copying, reproduction, distribution, modification, or public display of Content is strictly prohibited and constitutes a violation of the Author’s exclusive rights.
RomanSoft OÜ, an Estonian company, serves as the official representative of the NYMF platform within the European Union for marketing and payment processing purposes. However, all Content ownership, copyrights, and associated legal responsibilities remain exclusively with D. I. Dubnytskyi.
Prohibited Actions
The following actions are strictly prohibited unless expressly authorized in writing by D. I. Dubnytskyi:
– Copying, reproducing, or distributing Content outside the NYMF Mobile App or official websites (https://dubnitskiy.com and https://nymf.com).
– Editing, cropping, converting, or altering the Content, including but not limited to signing, adding watermarks, or converting to black-and-white or other formats outside the Services.
– Publishing or sharing the Content on the Internet or other platforms without the prior written consent of D. I. Dubnytskyi.
– Creating derivative works, compilations, or adaptations of the Content without explicit permission.
– Commercial exploitation of the Content in any form without a proper license or agreement.
– Removal of copyright notices, logos, or proprietary labels associated with the Content.
Violations of these prohibitions may result in legal action, including but not limited to injunctive relief, monetary damages, compensation for moral and material harm, and recovery of legal costs.
Authorized Use of Content
Access to the Content provided through the Services is granted to Users strictly for personal, noncommercial, and nonpublic use. Users are permitted to view and engage with the Content exclusively through the NYMF Mobile App and official websites (https://dubnitskiy.com and https://nymf.com).
The display of Content is intended solely for personal enjoyment, education, artistic appreciation, and inspiration. Unauthorized sharing, distribution, or commercial use of Content is strictly prohibited. Users must not remove or obscure any copyright notices, trademarks, or other proprietary information contained within the Content.
Any request for authorization to use the Content beyond personal use must be made in writing to the Author at [email protected]. No implied rights or licenses are granted through the use of the Services.
Copyright Violation and Legal Consequences
Illegal use of the Content, including but not limited to unauthorized reproduction, distribution, public display, or modification of Content, may result in the following legal actions:
– Immediate termination of access to the NYMF Mobile App and related websites.
– Blocking of websites or platforms where illegal Content is published.
– Filing of civil lawsuits for copyright infringement, seeking compensation for damages, pain and suffering, legal fees, and other associated costs.
– Criminal prosecution where applicable under the laws of Ukraine or other jurisdictions.
– Notice to digital platforms (e.g., social media networks, content-sharing websites) requesting the removal of infringing materials in compliance with the Digital Millennium Copyright Act (DMCA) or relevant laws in other jurisdictions.
Users are hereby informed that unauthorized use of the Content is subject to both civil and criminal liability and may result in significant legal penalties.
Reporting Copyright Infringement
If you believe that your work or the work of a third party that you are authorized to represent has been published or otherwise reproduced on the NYMF Mobile App or related websites without proper authorization, you may report the alleged infringement to the Author.
Please send a detailed copyright infringement notice to [email protected] with the following information:
– Identification of the copyrighted work claimed to have been infringed.
– Description of where the infringing material is located on the Services.
– Your contact information, including name, address, email, and phone number.
– A statement affirming that you have a good faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law.
– A statement made under penalty of perjury that the information in your notice is accurate and that you are authorized to act on behalf of the copyright owner.
– Your physical or electronic signature.
Upon receiving a valid copyright infringement notice, D. I. Dubnytskyi will investigate the claim and take appropriate action, which may include removing or disabling access to the allegedly infringing material.
